This Privacy Policy explains what personal information we collect when you visit modernorigindiamonds.com (the "Site"), buy from us, or contact us; how we use and share it; and the choices and rights you have. It applies to residents of all U.S. states. Some states give their residents additional rights, which are described in "Your Privacy Rights" below.
1. Information We Collect
Information you give us
- Contact and identity details: name, email address, phone number.
- Order details: shipping and billing address, items purchased and their options (for example metal, ring size, center stone, diamond size, bracelet length) and order history.
- Account details: if you create an account, your email address and login credentials.
- Requests and forms: messages you send through our contact form, consultation requests, custom design quote requests (including images, sketches and CAD files you upload, budget and timeline), and warranty claims (including order number, description of the issue and photos).

Payment information. Payments are processed by Stripe, Inc. and, if you choose a pay-over-time option, by providers such as Klarna, Affirm or Afterpay. Your full card number and bank details are entered directly with those providers and are not stored on our servers. We receive limited information such as payment status, card brand and the last four digits.
Information collected automatically. When you use the Site, we and our service providers automatically collect device and usage information, such as IP address, browser type, device type, pages viewed, referring page, and the date and time of your visit. Our Site stores items in your shopping bag in your browser so they are there when you return.
Information from others. We may receive information from payment and financing providers (for example, payment confirmation or fraud signals), shipping carriers (delivery status), Google if you choose to sign in with your Google account (your name, email address and profile photo), and social media platforms if you contact us there.
We do not knowingly collect sensitive personal information such as Social Security numbers, government ID numbers, precise geolocation, biometric data, or health information, and we ask that you not send it to us.
2. How We Use Your Information
We use personal information to:
- Process, make, ship and deliver your orders, and send order confirmations, shipping updates and receipts.
- Prepare custom design quotes and design approvals, and handle warranty claims, repairs, returns and exchanges.
- Respond to questions and requests and provide customer service.
- Create and manage your account.
- Send newsletters and marketing emails if you have opted in (you can unsubscribe at any time).
- Prevent fraud, secure our Site and payments, and enforce our terms.
- Operate, maintain and improve the Site and our products.
- Comply with legal obligations, such as tax, accounting and consumer protection requirements.
We do not use your personal information to make decisions that produce legal or similarly significant effects about you based solely on automated processing.
5. How Long We Keep Information
We keep personal information only as long as reasonably necessary for the purposes described in this Policy. For example, we keep order and warranty records for as long as your warranty coverage applies and as required for tax, accounting and legal purposes; we keep quote and contact requests for as long as needed to respond and follow up; and we keep newsletter information until you unsubscribe. When information is no longer needed, we delete or de-identify it.
6. Your Choices
- Marketing emails: click "unsubscribe" in any marketing email or contact us. We will still send transactional emails about your orders, quotes and warranty claims.
- Text messages: we do not send marketing text messages, and the Site does not ask you to sign up for them. If we ever offer them, we will send them only with your express written consent, and you can reply STOP to opt out at any time.
- Account information: you can sign in to review the orders placed with your email address and reset your password from the sign-in page. To update or delete other account information, contact us.
- Do Not Sell or Share My Personal Information: we do not sell or share personal information for targeted advertising. You can still submit an opt-out request using the contact information below, and we will record and honor it if our practices ever change.
- Cookies: see Section 4.
7. Your Privacy Rights
Depending on where you live, and subject to applicable exceptions, you may have the right to:
- Know and access the personal information we have collected about you, including the categories of information, sources, purposes and the categories of third parties we disclose it to.
- Correct inaccurate personal information.
- Delete personal information we have collected from you.
- Data portability: receive a copy of your personal information in a portable format.
- Opt out of the sale of personal information, sharing for targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects.
- Limit or consent to the use of sensitive personal information (we do not knowingly collect it).
- Obtain a list of the specific third parties to which we have disclosed personal information, where state law provides this right.
- Non-discrimination: we will not deny you goods or services, charge you different prices, or provide a different level of quality because you exercised your privacy rights.
These rights are provided to residents of states with consumer privacy laws, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia, as those laws take effect and apply. As a courtesy, we will consider requests from residents of any state.
How to submit a request. Email us at hello@modernorigindiamonds.com with the subject "Privacy Request," or use the contact form on our Contact page. Tell us which right you want to exercise. To protect your information, we will verify your identity, usually by matching information you provide with information we already have (for example, your email address and an order number). We will respond within 45 days, and if we need more time (up to an additional 45 days where permitted by law), we will tell you why.
Authorized agents. You may use an authorized agent to submit a request on your behalf. We may ask the agent for proof of your signed permission and may ask you to verify your identity directly, unless the agent holds a valid power of attorney.
Appeals. If we decline to act on your request, you may appeal by replying to our decision or emailing hello@modernorigindiamonds.com with the subject "Privacy Request Appeal" within a reasonable time. We will respond to your appeal in writing within the time required by your state's law (generally 45 to 60 days), including an explanation of our decision. If your appeal is denied, you may contact your state Attorney General.
California residents. In the past 12 months we have collected the following categories of personal information: identifiers (such as name, email, phone, postal address, IP address); customer records (such as payment status and order information); commercial information (products purchased and order history); internet or other electronic network activity (such as Site usage); audio, visual or similar information (photos and files you upload); and inferences limited to your product preferences. We collect this information from the sources described in Section 1, for the business purposes described in Section 2, and disclose each category to the service providers described in Section 3. We do not sell or share personal information, and we have no actual knowledge of selling or sharing the personal information of consumers under 16. Under California's "Shine the Light" law (Civil Code § 1798.83), California residents may request information about disclosures of personal information to third parties for their direct marketing purposes; we do not make such disclosures.
Nevada residents. We do not sell covered information as defined by Nevada law. You may still submit a request to opt out of future sales by emailing hello@modernorigindiamonds.com.
8. Children's Privacy
The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13, and we do not knowingly sell, share or process for targeted advertising the personal information of anyone under 18. If you believe a child has provided us personal information, contact us and we will delete it.
9. How We Protect Your Information
We use reasonable administrative, technical and physical safeguards designed to protect personal information, including encrypted (HTTPS) connections, access controls that limit order and customer records to authorized personnel, and private storage for files you upload. Payment card data is handled by PCI-DSS compliant payment processors. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you and any required authorities as required by applicable law.
10. Where We Process Information
We are based in the United States, and we and our service providers process and store information in the United States. Some of our manufacturing partners are located outside the United States and receive order specifications needed to make your jewelry. By using the Site, you understand that your information may be processed in countries whose data protection laws may differ from those in your state.
11. Third-Party Links and Services
The Site may link to third-party websites and services, such as social media pages, IGI grading report lookups, and financing providers. Their privacy practices are governed by their own policies, and we encourage you to review them. When you choose Klarna, Affirm or Afterpay, those providers collect information directly from you under their own privacy policies.
12. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version on this page and change the "Last updated" date above. If we make material changes, we will provide additional notice, such as by email or a notice on the Site, before the changes take effect where required by law.
